Off-Duty Officer-Involved Shooting in Gaithersburg

Updated Information

Montgomery County Police Detectives from the Major Crimes Division are investigating an off-duty officer-involved shooting that occurred at approximately 7:10 p.m. outside of the Church of the Redeemer located at 19425 Woodfield Road in Gaithersburg. The church was holding a special Thanksgiving service this evening.

Two male uniformed officers were actively directing traffic outside of the church. The suspect vehicle, a dark-colored SUV, was being driven erratically on Woodfield Road and pulled into the church parking lot. The two officers were trying to get the driver to slow down, when the suspect drove his vehicle at a high rate of speed toward one of the officers. The officer was struck by the vehicle and the officer opened fire at the vehicle, firing several rounds. The driver of the vehicle took off northbound on Woodfield Road. The struck officer, who has been a member of the department for five and a half years, was transported to an area hospital for treatment of injuries to his foot. He has now been released.

Detectives are currently investigating a person of interest pertaining to this case.

Following standard procedure, the struck officer has been placed on administrative traumatic incident leave.

Suspect Charged Who Assaulted Officer

Montgomery County Police Detectives from the Major Crimes Division continue to investigate an off-duty officer-involved shooting that occurred at approximately 7:10 p.m. yesterday outside of the Church of the Redeemer located at 19425 Woodfield Road in Gaithersburg. The church was holding a special Thanksgiving service Wednesday evening.

Through the course of the investigation the identity of the suspect who drove erratically on Woodfield Road and struck a Montgomery County Police officer was developed. He was located, taken into custody, and charged as an adult overnight. He was not struck by any of the rounds fired at his vehicle after he drove toward and struck the officer. Joseph W. Nelson, age 16, of the 23200 block of Rainbow Arch Drive in Clarksburg, was charged with first-degree assault. He remains at the Montgomery County Detention Center. Bond information is not yet available. The motive for the erratic driving and assault of the officer remain under investigation.

The two officers were trying to get the driver to slow down, when the suspect drove his vehicle at a high rate of speed toward one of the officers. That officer, Josue Zelaya who is assigned to the 4th District, was struck by the vehicle. Officer Zelaya opened fire at the vehicle, firing several rounds. The driver of the vehicle took off in a northbound direction on Woodfield Road. Officer Zelaya, who has been a member of the department for five and a half years, was transported to an area hospital for treatment of injuries to his foot. He was released last night. The identity of the other officer will not be released because he is a witness.

Following standard procedure, Officer Zelaya has been placed on administrative traumatic incident leave.
